Terms of Service

Telyn provides an AI-powered voice receptionist platform that handles inbound phone calls on behalf of your business. Features include automated call answering, appointment scheduling support, FAQ handling, lead capture, and call transcription, depending on your plan.

We reserve the right to modify, suspend, or discontinue any feature of the service at any time. We will provide reasonable advance notice of material changes.

You must be at least 18 years old and authorized to enter into contracts on behalf of the business you represent. By accepting these Terms, you represent and warrant that you meet these requirements.

You agree to provide accurate, current, and complete information during signup and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Notify us immediately at info@telyn.ai if you suspect unauthorized access to your account.

Plans.Telyn offers three monthly subscription tiers: Starter ($147/month standard, $97/month launch promotional pricing while available, 200 included minutes), Growth ($327/month, 1,500 included minutes), and Pro ($697/month, 2,500 included minutes). Customers who subscribe at the launch promotional price retain that rate for the lifetime of an active, uninterrupted subscription ("Lifetime Price Lock"). The Lifetime Price Lock terminates upon cancellation, non-payment lasting more than 30 days, or plan tier change. Standard pricing is subject to change with 30 days' notice.

Overage.Minutes used beyond your plan's included allowance are billed at $0.25 per minute, charged at the end of each billing cycle.

Free trial. New accounts receive a 7-day free trial. No charge is made during the trial period. If you do not cancel before the trial ends, your selected plan will automatically begin and your payment method will be billed.

Billing cycle. Subscriptions are billed monthly on the anniversary of your trial end date. All fees are charged in U.S. dollars.

Cancellation. You may cancel at any time through your account dashboard or by emailing us. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused time within a billing period.

Payment failures. If a payment fails, we will retry the charge and notify you by email. If the payment is not resolved within 7 days, your service may be suspended.

You agree not to use Telyn to:

• Violate any applicable law, regulation, or third-party right
• Engage in deceptive, fraudulent, or misleading practices toward callers
• Impersonate a human agent to callers in a way that violates applicable law (including FTC regulations requiring disclosure that callers may be speaking with an AI)
• Conduct unauthorized robocalling, telemarketing, or TCPA-violating campaigns
• Transmit spam, malware, or harmful content
• Attempt to reverse engineer, decompile, or disrupt the Telyn platform
• Resell or sublicense access to the service without our written consent

You are solely responsible for ensuring your use of Telyn complies with the Telephone Consumer Protection Act (TCPA), FCC regulations, state telemarketing laws, and any other applicable communications laws.

Legal services.Telyn is not a legal services provider, law firm, or attorney service. Telyn does not provide legal advice, legal opinions, or representation. Customers operating law firms or providing legal services are solely responsible for ensuring their Telyn agent's scripts, prompts, and caller interactions comply with applicable bar association rules, unauthorized practice of law (UPL) restrictions in Customer's jurisdiction, attorney-client privilege requirements, conflict-of-interest screening obligations, and professional ethics standards. Customer waives and releases any claim against Telyn arising from caller interactions touching on legal subject matter.

Healthcare, dental, veterinary, and PHI.Telyn is not HIPAA-compliant and has not entered into a Business Associate Agreement (BAA) with any customer. Customers operating in healthcare, dental, veterinary, behavioral health, or any field handling Protected Health Information (PHI) as defined under HIPAA must not configure the Telyn agent to solicit, capture, transmit, or store PHI of any kind. Customer indemnifies and holds Telyn harmless from any PHI inadvertently captured, transmitted, or stored as a result of Customer's configuration choices.

Financial services. Telyn is not a registered broker-dealer, investment advisor, or financial institution. Customers using Telyn in connection with financial advice, lending, securities, or insurance must independently ensure compliance with all applicable federal and state regulations including FINRA, SEC, state insurance commission, and consumer financial protection rules.

Lead and lease guarantees. Any performance guarantees Telyn publishes (including but not limited to lead-capture, appointment-set, or intake-volume guarantees) apply only to active, fully-configured paying accounts during a continuous 30-day period beginning on the date of first paid charge. Refund eligibility is determined solely by data captured within the Telyn dashboard. Customer agrees that the Telyn dashboard call log and lead counter are the sole and authoritative record for evaluating any guarantee claim.

Phone numbers provisioned through Telyn are provided by our telephony partners and are subject to carrier terms. Numbers remain the property of the underlying carrier. We do not guarantee number portability. Upon account termination, provisioned numbers may be released unless porting is arranged in advance.

An optional toll-free number add-on is available for $8/month. Local number provisioning is included with your plan where available.

You retain all rights to the data you and your callers provide through the Telyn platform ("Customer Data"). By using the service, you grant Telyn a limited license to process Customer Data solely to provide the service.

You are responsible for obtaining all necessary consents from callers to record, transcribe, and process their calls, including any required call-recording disclosures under applicable state law (e.g., two-party consent states).

Our use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Telyn and all associated technology, software, trademarks, and content are owned by Kingdom Catalyst LLC or its licensors. These Terms do not grant you any ownership rights in the Telyn platform.

You retain ownership of your business name, logo, scripts, and any proprietary content you configure within the platform.

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, carrier outages, or force majeure events may cause downtime. We are not liable for missed calls or business losses resulting from service interruptions.

THE TELYN SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC BUSINESS REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TELYN AND KINGDOM CATALYST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO TELYN IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) $100.

You agree to indemnify, defend, and hold harmless Telyn, Kingdom Catalyst LLC, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of applicable law; or (d) your callers' data or content.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Tennessee, and you consent to personal jurisdiction in those courts.

For minor disputes, we encourage you to contact us first at info@telyn.ai so we can attempt to resolve the issue informally.

Either party may terminate these Terms at any time. You may cancel your account as described in Section 4. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.

Upon termination, your right to use the service ends. Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, and 13) will continue in effect.

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on telyn.ai at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes your acceptance of the updated Terms.
